Powers of Attorney

A Power of Attorney is a legal document that gives someone else the right to act on your behalf.  Without a Power of Attorney in place, should you become incapacitated in the future, a person will be required to apply to court to become your guardian and thereby obtain the recognized authority to deal with matters on your behalf.  The guardianship application process can be quite emotional and expensive during a stressful time. 

Clients generally retain Daniel Wilson Law Office to prepare the following: 
  • Continuing Power of Attorney for Property - this document covers your financial affairs and allows the person you appoint (referred to as your "ATTORNEY”) to act on your behalf. Though the person can act for you at any time following your execution of the document, its existence is crucial should you become physically or mentally incapable. 
  • Power of Attorney for Personal Care - this document covers your personal decisions, such as housing and health care. You may wish for this document to include a "living will” clause, whereby you express that you do not want heroic measures to be taken in order to extend your life if there is no hope for recovery.

NOTE: Often people confuse a Will with a living will.  A "living will" is part of the Power of Attorney and therefore only applies while you are alive and ceases to be effective upon your death. Conversely, a "Last Will and Testament" covers the distribution of your property after you die and only takes effect upon your death.
